I know that nobody here cares except for the one person who asked before, but I said I would update when there was something to tell and I intend to keep my word. I had my court date, nothing happened except the prosecutor did formally file charges and now I have a new court date with a different judge.
And since this is all public record I am giving nothing away by saying that it is my mother-in-law who is accusing me of stealing her identity. I can't really discuss much else as I don't intend to show my hand when it comes to my defense. I know that most people will fall into one of 2 camps, there are those that will believe I am guilty even if I am acquitted and those who will believe I am innocent even if I am convicted. I know that I am in a no win situation here as no matter what happens, my husband is having to deal with the pain of betrayal by his mother and my children will have to deal with the loss of their grandmother as a part of their lives.
As for me, I have days that I think it better if I just die because then this whole thing goes away for my whole family. Then there are days I just want to fight, especially when I have concrete evidence that will impeach my mother-in-law's testimony on the stand. How much shit does everyone have to get drug through to get to that point? Anyway, there is my update, I'm sure there are those that will take glee in it but I understand what this blog is about. I'm not posting this on the veggie site, there is no point since the details would end up here anyway so I may as well cut out the middle man. Believe it or not, there is not a thing I can do for my defense on a Sunday afternoon. I have done what I can, my attorney takes care of the rest and he is doing a really good job.
I wish I could tell you what my mil's problem is. When we first found out she was saying her identity was stolen we asked her if she was accusing us and she said no. Then a week later she filed a police report naming me as the suspect. She claims to hate confrontation. Personally, I think being cross examined by a defense attorney is confrontation x 10.
I do have evidence that she is lying about a whole bunch of stuff. Unfortunately, nobody has bothered to ask me for my evidence until now. The police were not interested in anything I had to say, they only wanted me to give them ammo for the case they wanted to build. I refused to do that.
Honestly, everybody should go to their local court and spend a couple of hours watching what happens. This has been a real education. There was one woman who came in in shackles and prison stripes and the prosecutor said they weren't charging her with anything but they have the right to hold her for 60 days without charging her. So the judge set the date that she will have served 60 days and said they have to let her go on that date. How messed up is that?

Yes, I am still married to her son. He is 100% in my corner and is deeply hurt by his mother's actions. We were in the process of looking at a house to buy with in-law's quarters so that she could retire and live with us. She inherited her parent's house when they died and then stupidly took out a mortgage on it so she could pay off her car and decorate the house. She didn't bother to think ahead that she would eventually retire and could not afford that mortgage payment with only her social security. She had a 401k and cashed it out because she wanted some new jewelry and clothes. She made a bunch of stupid financial mistakes and has nothing to retire on and we felt obligated to help her.
We were giving her money every month and made every repair on her house that it needed so she could put it on the market and sell it. We had asked my sil to contribute to the care of her mother and she remarked that she thought that was "lame". So we felt we were on our own in making sure she was cared for. This all came out of nowhere. My children are her only grandchildren and will be the only grandchildren she ever has. My husband is the only one of her children who has a decent career and has any means to care for her as she gets older. I don't know what she plans to do, but knowing her, she hasn't thought that far ahead.
The weird thing is, I have had a credit card stolen before. I did what normal people do, I contacted the bank, they refunded my money, and whatever happened after that wasn't my concern. I don't know if they caught the people or not, what did it matter to me? I wasn't out anything. But not my mil. With no evidence at all, she decided that I had to be the one. Her sister is friends with the local pd so they weren't going to just laugh her off and hey, now they didn't have to actually investigate. Hell, one of her claims is that I went shopping using her credit card on a particular date. Problem with that scenario is that at that time I was in the hospital having surgery under anesthesia. Needless to say, that one is easy to prove.

Because that isn't how the legal process works. It is possible that the new judge will throw it out for lack of evidence. I hope for that. But if not, then this can drag out for a LONG time. In the meantime, the stress level in my home is through the roof and my children suffer. No matter how hard I try, they suffer. How do you tell your 10 year old that Granny is batshit crazy and is trying to send your mom to jail? This sucks, it just does. If I could save my kids from this, I would. If I could snap my fingers and make it go away, I would. And do I take a deal to make it all end faster? That means I have to plea guilty to something I didn't do. That sucks too.
I have not had an opportunity to present my evidence to a judge yet. In preliminary hearings the state is given every benefit of the doubt. That changes once the defense gets to put on their case in chief. The state has just now filed a motion for discovery which means they now are willing to see evidence that shows my mother-in-law is a liar. Hopefully, they will see that and dismiss the charge. But who knows what will happen? In the meantime, it all sucks ass.

I'm going to come clean. I was addicted to prescription pain killers. I used an acquaintance's ID to commit some theft. She was arrested and jailed for 3 days. And they had VIDEO. This was in the late 80's, though, with b/w grainy video. We looked similar enough they couldn't tell the difference on the tape. I turned myself over to them, because I was going to jail anyway on an unrelated matter. I figured (and was right) they would run my sentences concurrently, and I felt horrible about her sitting in jail innocent.
I know she was treated as a liar, as a thief. She would have eventually beaten it, as she had a rock hard alibi. BUT, not until court months later, had I not come forward.
The wheels of justice turn slowly. Just about anyone can swear out a warrant, and the defendant doesn't get a say in it until court. Hell, even the police do this. Once I was arrested for DWI(drugs, not alcohol), and I was stone cold sober. I was in severe withdrawls and just about out of my mind. I was arrested, taken for blood tests and spent the night in jail, where I bonded out the next day. It took my test results months to come back, and my case was dismissed. I hold no grudges, because there were many times I WAS DWI, and didn't get caught. Karma is a bitch.
So, you see, our system CAN jail innocent people. I'm not saying banana is, but it IS possible.

Because my husband's sister had already sent him a flurry of text messages earlier that day accusing us. So, he attempted to clarify that with his mom. And she denied it. So, we brought his phone and read off the texts and his mom said that was all his sister and she had nothing to do with it. Then, my mil claims on the police report the reason she suspected me was because after she told me about her identity being stolen I paid one of the credit cards off in full. I can't wait to see the evidence proving that.

I make about $175,000 a year. If I do a bunch of OT or earn an extra fat commission I get up to 200k. That is about average for people my age at my career level, I am 40 and deputy director of IT ops for a medium sized engineering house in Silicon Valley. I don't know anyone who pays as much in taxes as any of us makes in salary. That would mean they are earning at least a million dollars a year and don't have a fucking clue about tax shelters. I know people who make a million dollars a year, its just that there arent that many of them below the C level.

I have had so many people ask me why I don't just try to talk to mil to see what she wants but once a police report is filed it is a whole new game. I can't understand this. My mind is reeling and I just don't know how to handle this.

Not that I am aware of 195. And obviously, nobody in my immediate family can get anywhere near her without risking being charged. My sil is calling a lot of the shots. And she is a miserable 300 lb drug addict whose only purpose in life is to make everyone as miserable as she is. I've got pissy emails from her dating back 10 years. And she neglected to mention to the prosecutor all the hateful, harassing messages she sent to my daughter back in January because my daughter had the audacity to unfriend her. Good thing I have copies of all that. Especially since mil was BCC'd on all of them. I guess we should have filed reports with the police so they would know this is all just a family squabble and not worth their time. I know that nobody here cares except for the one person who asked before, but I said I would update when there was something to tell and I intend to keep my word. I had my court date, nothing happened except the prosecutor did formally file charges and now I have a new court date with a different judge.
And since this is all public record I am giving nothing away by saying that it is my mother-in-law who is accusing me of stealing her identity. I can't really discuss much else as I don't intend to show my hand when it comes to my defense. I know that most people will fall into one of 2 camps, there are those that will believe I am guilty even if I am acquitted and those who will believe I am innocent even if I am convicted. I know that I am in a no win situation here as no matter what happens, my husband is having to deal with the pain of betrayal by his mother and my children will have to deal with the loss of their grandmother as a part of their lives.
As for me, I have days that I think it better if I just die because then this whole thing goes away for my whole family. Then there are days I just want to fight, especially when I have concrete evidence that will impeach my mother-in-law's testimony on the stand. How much shit does everyone have to get drug through to get to that point? Anyway, there is my update, I'm sure there are those that will take glee in it but I understand what this blog is about. I'm not posting this on the veggie site, there is no point since the details would end up here anyway so I may as well cut out the middle man. I could say nothing at all but this is all publicly available information and if some internet detective tried hard enough, they would find it and then it looks like I am hiding something.
Even if you wish nothing but the worse for me, I do hope that you will at least hope for the best for my children and husband. They truly do not deserve this.

Believe it or not, there is not a thing I can do for my defense on a Sunday afternoon. I have done what I can, my attorney takes care of the rest and he is doing a really good job.
I wish I could tell you what my mil's problem is. When we first found out she was saying her identity was stolen we asked her if she was accusing us and she said no. Then a week later she filed a police report naming me as the suspect. She claims to hate confrontation. Personally, I think being cross examined by a defense attorney is confrontation x 10.
I do have evidence that she is lying about a whole bunch of stuff. Unfortunately, nobody has bothered to ask me for my evidence until now. The police were not interested in anything I had to say, they only wanted me to give them ammo for the case they wanted to build. I refused to do that.
Honestly, everybody should go to their local court and spend a couple of hours watching what happens. This has been a real education. There was one woman who came in in shackles and prison stripes and the prosecutor said they weren't charging her with anything but they have the right to hold her for 60 days without charging her. So the judge set the date that she will have served 60 days and said they have to let her go on that date. How messed up is that?

Yes, I am still married to her son. He is 100% in my corner and is deeply hurt by his mother's actions. We were in the process of looking at a house to buy with in-law's quarters so that she could retire and live with us. She inherited her parent's house when they died and then stupidly took out a mortgage on it so she could pay off her car and decorate the house. She didn't bother to think ahead that she would eventually retire and could not afford that mortgage payment with only her social security. She had a 401k and cashed it out because she wanted some new jewelry and clothes. She made a bunch of stupid financial mistakes and has nothing to retire on and we felt obligated to help her.
We were giving her money every month and made every repair on her house that it needed so she could put it on the market and sell it. We had asked my sil to contribute to the care of her mother and she remarked that she thought that was "lame". So we felt we were on our own in making sure she was cared for. This all came out of nowhere. My children are her only grandchildren and will be the only grandchildren she ever has. My husband is the only one of her children who has a decent career and has any means to care for her as she gets older. I don't know what she plans to do, but knowing her, she hasn't thought that far ahead.
The weird thing is, I have had a credit card stolen before. I did what normal people do, I contacted the bank, they refunded my money, and whatever happened after that wasn't my concern. I don't know if they caught the people or not, what did it matter to me? I wasn't out anything. But not my mil. With no evidence at all, she decided that I had to be the one. Her sister is friends with the local pd so they weren't going to just laugh her off and hey, now they didn't have to actually investigate. Hell, one of her claims is that I went shopping using her credit card on a particular date. Problem with that scenario is that at that time I was in the hospital having surgery under anesthesia. Needless to say, that one is easy to prove.

Because that isn't how the legal process works. It is possible that the new judge will throw it out for lack of evidence. I hope for that. But if not, then this can drag out for a LONG time. In the meantime, the stress level in my home is through the roof and my children suffer. No matter how hard I try, they suffer. How do you tell your 10 year old that Granny is batshit crazy and is trying to send your mom to jail? This sucks, it just does. If I could save my kids from this, I would. If I could snap my fingers and make it go away, I would. And do I take a deal to make it all end faster? That means I have to plea guilty to something I didn't do. That sucks too.
I have not had an opportunity to present my evidence to a judge yet. In preliminary hearings the state is given every benefit of the doubt. That changes once the defense gets to put on their case in chief. The state has just now filed a motion for discovery which means they now are willing to see evidence that shows my mother-in-law is a liar. Hopefully, they will see that and dismiss the charge. But who knows what will happen? In the meantime, it all sucks ass.

As far as my kids are concerned? Well, they were home when the cops came to arrest me. SO completely hiding everything from them would be a bit impossible. I'm going to come clean. I was addicted to prescription pain killers. I used an acquaintance's ID to commit some theft. She was arrested and jailed for 3 days. And they had VIDEO. This was in the late 80's, though, with b/w grainy video. We looked similar enough they couldn't tell the difference on the tape. I turned myself over to them, because I was going to jail anyway on an unrelated matter. I figured (and was right) they would run my sentences concurrently, and I felt horrible about her sitting in jail innocent.
I know she was treated as a liar, as a thief. She would have eventually beaten it, as she had a rock hard alibi. BUT, not until court months later, had I not come forward.
The wheels of justice turn slowly. Just about anyone can swear out a warrant, and the defendant doesn't get a say in it until court. Hell, even the police do this. Once I was arrested for DWI(drugs, not alcohol), and I was stone cold sober. I was in severe withdrawls and just about out of my mind. I was arrested, taken for blood tests and spent the night in jail, where I bonded out the next day. It took my test results months to come back, and my case was dismissed. I hold no grudges, because there were many times I WAS DWI, and didn't get caught. Karma is a bitch.
So, you see, our system CAN jail innocent people. I'm not saying banana is, but it IS possible.
And before you detectives pull an all-nighter, I'm no one. I could give you my name, address, and life story, and it wouldn't matter a bit.

Because my husband's sister had already sent him a flurry of text messages earlier that day accusing us. So, he attempted to clarify that with his mom. And she denied it. So, we brought his phone and read off the texts and his mom said that was all his sister and she had nothing to do with it. Then, my mil claims on the police report the reason she suspected me was because after she told me about her identity being stolen I paid one of the credit cards off in full. I can't wait to see the evidence proving that.

I make about $175,000 a year. If I do a bunch of OT or earn an extra fat commission I get up to 200k. That is about average for people my age at my career level, I am 40 and deputy director of IT ops for a medium sized engineering house in Silicon Valley. I don't know anyone who pays as much in taxes as any of us makes in salary. That would mean they are earning at least a million dollars a year and don't have a fucking clue about tax shelters. I know people who make a million dollars a year, its just that there arent that many of them below the C level.

I'm burned out on FB. I'm in the process of paring my friends list down severely to only people I enjoy and interact with since mine's recently turned into a shit fest of:
Whackadoodle conspiracy theorists. Defriended.
Racists. Defriended.
Nasty political crap (I do like the thoughtful, sane, respectful stuff). Defriended.
The "like if you love Jesus" crap is annoying. You get put on "important only". Same with the 3,943 ecards-a-day, drug test welfare bums!, 50000000000000 likes for this hairlipped kid, like for a free ipod, etc etc, drivel. You are morans.
I have a little over 200 friends and there are only three that ever put that annoying stuff. And I don't defriend them because they are DH's relatives. Well if it was racist/other bad stuff I would defriend them, but it's just the "hit share if you love your sister" type stuff. I just scroll by.
I did block 2 friends during the election time for disgusting, hateful stuff. They were just old scrapping acquaintances, nbd.
I guess I've been super lucky w/ my FB friends -every time there's a thread about FB on the pod, people complain about all the junk/drama and I guess I just don't know more than 3 people that do that shit. My FB feed is just normal statuses and photos.
In my case, I think a lot of the sane people stopped posting so much (for whatever reason) which makes the loons/assholes more apparent.
I have a new update. It is mostly good news for me as there is absolutely no evidence. And I do mean none. I know some people here won't believe that but it doesn't matter. I would not be surprised to see this get multiple continuances and then thrown out.
The bad news is that my mil is now trying to prosecute my daughter for sending her messages on facebook. They are saying she was intimidating a witness. She was a grandaughter trying to understand why her grandmother was doing this. She didn't threaten her, she merely asked why? I have had so many people ask me why I don't just try to talk to mil to see what she wants but once a police report is filed it is a whole new game. I can't understand this. My mind is reeling and I just don't know how to handle this.
Is there someone else close enough to her who can get Grandma involuntarily committed? She sounds like she needs some help.

Then don't friend people from high school. Facebook is fun and has so much to offer. It's what you make it and what you allow it to be. You have complete control over who and what you see and how you use it.

Not that I am aware of 195. And obviously, nobody in my immediate family can get anywhere near her without risking being charged. My sil is calling a lot of the shots. And she is a miserable 300 lb drug addict whose only purpose in life is to make everyone as miserable as she is. I've got pissy emails from her dating back 10 years. And she neglected to mention to the prosecutor all the hateful, harassing messages she sent to my daughter back in January because my daughter had the audacity to unfriend her. Good thing I have copies of all that. Especially since mil was BCC'd on all of them. I guess we should have filed reports with the police so they would know this is all just a family squabble and not worth their time. But it just didn't seem criminal worthy and who wants to waste resources like that?

I don't think I'd lose one second of sleep over her trying to press charges on your daughter. Really, just because someone doesn't like what they hear doesn't mean they can send someone off to jail for it. We'd all be in jail.
I have a relative like that. Just fucking nutballs. Pot head, ignorant, has grand thoughts of himself that he's so much smarter than anyone else. He's an embarassment.
