As much as I would love to share all the details of my case, my attorney frowns on that so ya'll are just going to have to wait until this is over before I can spill all. Suffice it to say, that so far nobody has guessed correctly and this has absolutely nothing to do with my kids. That whole thing was found as a false report and we haven't had an issue with CPS since they closed our case.
I am going to have a lot of court appearances because I am fighting the charges tooth and nail. Criminal court cases are only over with quickly when either the charges get dismissed or there is a plea deal. For a jury trial you have to go through voir dire and a ton of motions and it takes a long time. My best outcome will be if the prosecutor dismisses the charges, which is always a possibility. And I won't even know what the charges are until they read them to me in court tomorrow.
So, if you have questions, I'm ere and I'll answer them if it doesn't effect my case negatively. I can't go into tons of detail, sorry to disappoint.

Maybe I shouldn't have posted about this anywhere. Focusing on what to wear helped serve as a distraction for me. My attorney has a general idea what the prosecutor is planning. But until the charges are officially read, nothing is written in stone. The main thing we know is that they desperately want me to confess or plead out because they don't want to take it to court. From what I have been able to see evidence wise, they have no case. Time will tell. I live in a shitty small town with a good ol boy network that I am on the wrong side of. I'm not naive enough to believe that innocence is enough. Anyone who does believe that needs to learn a lot more about our legal system.

They didn't serve me any papers. You can think it is bullshit all you want. I got nothing but a little slip of paper that shows as a receipt for the money my husband paid to bond me out. My attorney has told me there is nothing unusual about that.
And what he told me is that he has a very small piece of information and he needs a bunch of very large pieces. He will get those in the discovery phase. We aren't there yet.
I have a copy of the police report and I got to briefly read the affidavit provided to the prosecutor which basically just stated the same stuff as the police report with a few extra embellishments. I know they want to prosecute as a felony and that they are not pushing for jail time. But they REALLY want a confession.

It would be easy to tell someone that the weatherman says it is going to snow tomorrow and if the person hasn't looked at a weather report and it is winter then they might very well believe that it will snow. Show them a weather report that says otherwise and now that original evidence is not nearly as convincing as it was before. My point is, nobody has looked at the weather report, they are all going on the person who said it was going to snow.

No, they don't tell you what they are arresting you for. Stop watching CSI, what happens on tv is not what happens in real life. What they have listed on the police report is not what they have listed on other documents, documents which I have not been allowed to have copies of and when I tried to read them I was told I had an "attitude" and got to back into the jail for an additional hour. I get it that people want to believe that our system of "justice" is flawless and that everything always happens a certain way every time. All I can say to that is, that I sincerely hope you never have to find out differently.
I too was surprised by how quickly my court date was scheduled. It hasn't allowed me much time to work on my defense and I certainly haven't gotten to interview the number of attorneys I would have liked. I've had to spend a great deal of time arranging dr.s appointments and making sure I have all my ducks in a row so that I don't have to attempt to come off my Effexor cold turkey since doing that can cause seizures and when I was there before the jail did not care if I had seizures or not.
All I can do is try to keep my head above water and get through this thing. I am lucky that my husband has been there for me 100% and he managed to deal with the police dicking him around too and he was just trying to make sure I was okay and do whatever he had to to get me out. I was arrested in front of my children and there are scars that may never heal. But I have a loving family and a network of supportive friends who have bent over backwards for me.
This is the beginning of a very long, drawn out battle.

I am saying that what the cops told me they were arresting me for does not match the charge on the police report and neither of those charges match what is on the affidavit that was sworn to the prosecutor. The prosecutor is the only person who has the power to file charges. Last I heard, he hadn't done so yet, it is just a case scheduled to go to court. Tomorrow the prosecutor will either state that he wants to case dismissed or he will have whatever charges read that he wants to file.
The prosecutor did not ask the judge for a warrant, the police investigator did. He even admitted to me that the police report was considered probable cause. Look it up. If a citizen states in an affidavit that someone did something, it is considered probable cause. Does that mean that conviction is a foregone conclusion? Of course not, they have to prove what that person claimed beyond a reasonable doubt. But they can drag you to hell and back in the meantime.

My attorney's advice as far as attire is concerned will be best used when I am sitting in front of a jury and the judge who will actually be hearing my case. The judge I see tomorrow will not be the one who hears my case. He is a district court judge and my case is going to circuit court.
You know I don't know how easy it would be to commit financial identity fraud. I assume you would have to know someone's personal info like SSN and birthdate and such. I know it is different than credit card theft though because I had a credit card number stolen before and all I had to do was notify the issuing bank and I was not held responsible for the bogus charges. What the bank did with that info, I have no idea. But I'm assuming that whomever stole that card number didn't know all my personal info, I always thought they just swiped the credit card number. They bought plane tickets and some crap from another country.

They will most likely drop the charges in April. The police investigator handed the prosecuting attorney a shit sandwich and now the prosecutor has to try to figure out what to do with it. The prosecutor is hoping that over the next 6 weeks he'll be able to gather enough evidence to charge something. But that is why I couldn't find out the charges, so far there are none. The police investigator made his recommendation, but the prosecutor is the one who files charges.
Well, I don't get paid to run a law school so you are just going to have to figure it out on your own. People get arrested for stuff they didn't do all the time, And when you get arrested you have to go to court. Going to court does not = guilty. Please never serve on a jury. You obviously are incapable of understanding basic law.
And I watched a guy in court today that had his case dismissed and they cut him a check right there for 90% of his bail money back. Because the sheriff's department keeps 10% of it even if they arrested you and can't back up the reason why. You are out that money forever just because. I'm sure nobody will believe that either. As much as I would love to share all the details of my case, my attorney frowns on that so ya'll are just going to have to wait until this is over before I can spill all. Suffice it to say, that so far nobody has guessed correctly and this has absolutely nothing to do with my kids. That whole thing was found as a false report and we haven't had an issue with CPS since they closed our case.
I am going to have a lot of court appearances because I am fighting the charges tooth and nail. Criminal court cases are only over with quickly when either the charges get dismissed or there is a plea deal. For a jury trial you have to go through voir dire and a ton of motions and it takes a long time. My best outcome will be if the prosecutor dismisses the charges, which is always a possibility. And I won't even know what the charges are until they read them to me in court tomorrow.
So, if you have questions, I'm ere and I'll answer them if it doesn't effect my case negatively. I can't go into tons of detail, sorry to disappoint.

Maybe I shouldn't have posted about this anywhere. Focusing on what to wear helped serve as a distraction for me. My attorney has a general idea what the prosecutor is planning. But until the charges are officially read, nothing is written in stone. The main thing we know is that they desperately want me to confess or plead out because they don't want to take it to court. From what I have been able to see evidence wise, they have no case. Time will tell. I live in a shitty small town with a good ol boy network that I am on the wrong side of. I'm not naive enough to believe that innocence is enough. Anyone who does believe that needs to learn a lot more about our legal system.

They didn't serve me any papers. You can think it is bullshit all you want. I got nothing but a little slip of paper that shows as a receipt for the money my husband paid to bond me out. My attorney has told me there is nothing unusual about that.
And what he told me is that he has a very small piece of information and he needs a bunch of very large pieces. He will get those in the discovery phase. We aren't there yet.
I have a copy of the police report and I got to briefly read the affidavit provided to the prosecutor which basically just stated the same stuff as the police report with a few extra embellishments. I know they want to prosecute as a felony and that they are not pushing for jail time. But they REALLY want a confession.
I don't doubt that they think their evidence is convincing. Why, they haven't had to present it while it is being challenged. It would be easy to tell someone that the weatherman says it is going to snow tomorrow and if the person hasn't looked at a weather report and it is winter then they might very well believe that it will snow. Show them a weather report that says otherwise and now that original evidence is not nearly as convincing as it was before. My point is, nobody has looked at the weather report, they are all going on the person who said it was going to snow.

No, they don't tell you what they are arresting you for. Stop watching CSI, what happens on tv is not what happens in real life. What they have listed on the police report is not what they have listed on other documents, documents which I have not been allowed to have copies of and when I tried to read them I was told I had an "attitude" and got to back into the jail for an additional hour. I get it that people want to believe that our system of "justice" is flawless and that everything always happens a certain way every time. All I can say to that is, that I sincerely hope you never have to find out differently.
I too was surprised by how quickly my court date was scheduled. It hasn't allowed me much time to work on my defense and I certainly haven't gotten to interview the number of attorneys I would have liked. I've had to spend a great deal of time arranging dr.s appointments and making sure I have all my ducks in a row so that I don't have to attempt to come off my Effexor cold turkey since doing that can cause seizures and when I was there before the jail did not care if I had seizures or not.
All I can do is try to keep my head above water and get through this thing. I am lucky that my husband has been there for me 100% and he managed to deal with the police dicking him around too and he was just trying to make sure I was okay and do whatever he had to to get me out. I was arrested in front of my children and there are scars that may never heal. But I have a loving family and a network of supportive friends who have bent over backwards for me.
This is the beginning of a very long, drawn out battle.

I am saying that what the cops told me they were arresting me for does not match the charge on the police report and neither of those charges match what is on the affidavit that was sworn to the prosecutor. The prosecutor is the only person who has the power to file charges. Last I heard, he hadn't done so yet, it is just a case scheduled to go to court. Tomorrow the prosecutor will either state that he wants to case dismissed or he will have whatever charges read that he wants to file.
The prosecutor did not ask the judge for a warrant, the police investigator did. He even admitted to me that the police report was considered probable cause. Look it up. If a citizen states in an affidavit that someone did something, it is considered probable cause. Does that mean that conviction is a foregone conclusion? Of course not, they have to prove what that person claimed beyond a reasonable doubt. But they can drag you to hell and back in the meantime.
I don't care if people ask me about it or not. If the shoe were on the other foot, hell I would be curious too. Anyone who states otherwise is lying.

You know I don't know how easy it would be to commit financial identity fraud. I assume you would have to know someone's personal info like SSN and birthdate and such. I know it is different than credit card theft though because I had a credit card number stolen before and all I had to do was notify the issuing bank and I was not held responsible for the bogus charges. What the bank did with that info, I have no idea. But I'm assuming that whomever stole that card number didn't know all my personal info, I always thought they just swiped the credit card number. They bought plane tickets and some crap from another country.

They will most likely drop the charges in April. The police investigator handed the prosecuting attorney a shit sandwich and now the prosecutor has to try to figure out what to do with it. The prosecutor is hoping that over the next 6 weeks he'll be able to gather enough evidence to charge something. But that is why I couldn't find out the charges, so far there are none. The police investigator made his recommendation, but the prosecutor is the one who files charges.
Sorry I shouldn't have said drop the charges, there are none to drop. The correct terminology would be that they would dismiss the case.

People get arrested for stuff they didn't do all the time, And when you get arrested you have to go to court. Going to court does not = guilty. Please never serve on a jury. And I watched a guy in court today that had his case dismissed and they cut him a check right there for 90% of his bail money back. Because the sheriff's department keeps 10% of it even if they arrested you and can't back up the reason why. You are out that money forever just because. I'm sure nobody will believe that either. Hope you never find out first hand.
